Terms and Conditions for Boricua Party Rentals LLC

These Terms and Conditions govern the rental of items from Boricua Party Rentals LLC ("Company") to the customer ("Renter"). By renting items from the Company, the Renter agrees to be bound by these Terms and Conditions.

1. Rental Agreement

  • A rental agreement will be created for each rental, outlining the specific items rented, the rental period, and the total rental cost.

  • The Renter is responsible for ensuring the accuracy of the items listed in the rental agreement.

  • The rental agreement must be signed by the Renter or an authorized representative.

2. Reservations and Payments

  • A deposit may be required to reserve rental items. The amount of the deposit will be specified in the rental agreement.

  • The remaining balance is due the morning of the scheduled delivery or pick-up date.

  • Payments can be made via credit card (Online), cash or check.

  • If paying by check, the check must clear before the items are released.

  • A late fee of $10 dollars per day will be charged for overdue payments.

3. Cancellation Policy

  • Cancellations must be made at least 2 day (48 hours) prior to the scheduled delivery or pick-up date to receive a full refund of the deposit.

  • Cancellations made over 24 hours-47 hours prior to the scheduled delivery or pick-up date will result in forfeiture of the deposit.

  • Cancellations made less than 24 hours prior to the scheduled delivery or pick-up date will result in forfeiture of the full deposit and will be charged 20% of full rental agreement 

4. Delivery and Pick-Up

  • The Company will deliver and pick up the rental items at the location specified by the Renter.

  • The Renter is responsible for providing clear and accessible delivery and pick-up locations.

  • Additional charges may apply for deliveries outside of the Company's standard delivery area or for deliveries requiring special handling (e.g., long distances).

  • The Renter or an authorized representative must be present at the delivery and pick-up location at the scheduled times.

  • If the Renter is not present for delivery or pick-up, the Company may leave the items at the designated location, and the Renter will be responsible for their security. Alternatively, the Company may return the items to the Company's premises, and the Renter will be responsible for any additional delivery charges.

5. Rental Period

  • The rental period is specified in the rental agreement.

  • The Renter's right of possession terminates upon the expiration of the rental period.

  • Late returns will be subject to a late fee of the full amount of the item/s normal rental price per day.

  • If items are not returned within 3 days of the due date, the Company may consider the items lost, and the Renter will be responsible for the full replacement cost plus any late fees accrued.

6. Use of Rental Items

  • The Renter is responsible for using the rental items in a safe and proper manner, in accordance with any provided instructions.

  • The Renter is responsible for obtaining any necessary permits or licenses for the use of the rental items.

  • The Renter will use the rented items only for their intended purpose.

  • The Renter will comply with all applicable laws and ordinances regarding the use of the rental items.

  • The following uses are prohibited: smoking in or around rentals items unless approved by company.

7. Damage to or Loss of Rental Items

  • The Renter is responsible for the care of the rental items during the rental period.

  • The Renter is responsible for all damage to or loss of the rental items, except for normal wear and tear.

  • The Renter must report any damage or loss to the Company immediately.

  • The Renter will be charged the full replacement cost for any lost or irreparably damaged items plus 1 days rentals.

  • Damage fees will be assessed based on the cost of repair or replacement.

  • The Company's assessment of damage is final.

8. Liability and Indemnification

  • The Company is not liable for any injuries or damages arising from the use of the rental items.

  • The Renter agrees to indemnify and hold the Company harmless from any and all claims, losses, liabilities, and expenses (including attorney's fees) arising from the Renter's use of the rental items.

  • This includes any claims for personal injury, property damage, or other damages.

9. Inspection of Items

  • The Renter has the right to inspect the rental items upon delivery or pick-up.

  • Any existing damage or defects must be reported to the Company at that time.

  • If damage or defects are not reported at the time of delivery or pick-up, the Renter will be deemed to have accepted the items in good condition.

10. Security Deposit

  • A security deposit may be required in addition to the rental fee.

  • The security deposit will be used to cover any damage to or loss of the rental items beyond normal wear and tear, any unpaid charges, or any other breach of these Terms and Conditions.

  • The security deposit, or any remaining balance, will be refunded to the Renter within 5 days after the return of the rental items, provided that all items are returned in good condition and all charges have been paid.

11. Force Majeure

  • The Company is not responsible for any failure to perform its obligations under the rental agreement due to events beyond its reasonable control, including but not limited to, acts of God, war, labor disputes, accidents, or equipment failures.

12. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Pennsylvania/ Abington Township, PA located within Montgomery County 

13. Entire Agreement

  • These Terms and Conditions, together with the rental agreement, constitute the entire agreement between the Company and the Renter.

  • Any modifications or waivers of these Terms and Conditions must be in writing and signed by both parties.

14. Severability

  • If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Acceptance of Terms

  • By renting items from Boricua Party Rentals LLC, the Renter acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.

  • The signature on the rental agreement serves as an acknowledgement of these terms and conditions.
